Absolute rights are those which have <br />been developed and the indicated amount of water put to beneficial use. Conditional rights are <br />those which are in the process of being developed, but, in general, the necessary faciiities have <br />not been constructed and no water has yet been diverted or used. <br /> <br />A comprehensive investigation of water rights in and around the San Miguel Project study area <br />was undertaken to determine the location of diversions, decreed amounts and the priorities of <br />established water rights, This information was used in the analysis of water which would be <br />physically and legally available to a potential San Miguel Project as described in the following <br />section of this chapter, <br /> <br />Water rights information was obtained from the following sources: <br /> <br />1) The State Engineer's official July 1, 1984 Water Rights Tabulation and July 1, <br />1984 Abandonment List for Water Division 4. <br /> <br />2) The State Engineer's Water Rights Data Base listing for Water District's 60, 61 <br />and 63 as of January 1, 1986. <br /> <br />3) Lists of water rights held by the Farmers' Water Development Company, J&M <br />Hughes, Lilylands Canal and Reservoir Company, Lone Cone Ditch & Reservoir <br />Company, and SMWCD reported in the 1985 rescoping study and the 1985 Lone <br />Cone Reservoir enlargement feasibiiity report. <br /> <br />4) The files of the Farmers' Water Development Company and the Lilylands Canal <br />and Reservoir Company. <br /> <br />5) The CWCB's listing of minimum in-stream flow water rights on the San Miguel <br />River and its tributaries. <br /> <br />Preliminary lists of the water rights held by the potential project participants were compiled form <br />the information obtained from the State Engineer's Office and compared to the listings reported <br />in previous studies and information received from the ditch companies, Apparent <br />discrepancies, if any, were resolved where possible by review of supplementary information <br />contained in the State Engineer's Water Rights Data Base. A preliminary tabulation of other <br />water rights which should be considered in the analysis of water available to a potential project <br />was also compiled, <br /> <br />16 <br />
