Box 667, <br />-MQntp vi~t~ Colorado 81144 <br />hereinafter referred to as the contractor, <br /> <br />1982.., by and betwccn the <br />NA'fURl\I, RESOURCES <br /> <br />WHEREAS. aUlhority exists in the Law and funds have been budgeted. appropriated alld otherwise made <br />;Ivai/;lhlc and a sufficient unencumbercd balance thereof remains available for payment in Fund Number 4008 <br />G/l Account Number l;1:111Y , Contracl Encumbrance Number<:?J<33q~~md <br />, <br /> <br />.WHEREAS. required approval, clearance and coordinalion has been accomplished from .md with appropriate <br />;'l!l'Ul'IC,,;; :uld <br /> <br />WHEREAS, '3 pursuant to the provisions of 37-60-119, Colorado Revised Statutes <br />1973, as amended, the State is authorized to construct certain water projects for <br />tile benefit o[ the people of the statej and <br /> <br />WHEREAS, the Contractor is an irrigation company i~ the State of Colorado <br />and wishes to unaertake repairs of the Terrace Reservoir Project hereinafter <br />callea the project, for the members of the Terrace Irrigation Company in Conejos <br />County, Coloraao, at an estimatea cost of about six Hunored Twenty Thousand six <br />Hundred Dollars ($620,600); and <br /> <br />WHEREAS, the State has agreed to construct part of said project and to sell <br />the same to the Contractor upon mutually agreeable termS and conditions. subject <br />to the approval of appropriations for that purpose by t~e Colorado General <br />^:;;.cmbly and the Governor of the Stiltc of Colorado; and <br /> <br />WHEREAS, pursuant to Senate Bill No, 67, Fifty-Second General Assembly of <br />the State of COlorado, duly enacted by the Colorado General Assembly and approved <br />by the Governor of the State of COlorado, there was appt'opriated to the State the <br />sum of six Hundred and Twenty Thousand six Hundred Dollars ($620,600) for the <br />construction of parts of the project; and <br /> <br />WHEREAS, the Contractor has available from its own sources and from other <br />sources sufficient funds to construct the remainder of the project; <br /> <br />NOW THEREFORE, in consideration of the mutual and dependent covenants herein <br />contained, it is agre~d by the parties as follows: <br /> <br />A. The Contractor agrees that it will~&'''''' <br /> <br />1. Cause the construction of said project to be completed within two (2) <br />years of the date of this contract in accordance with the project plans and <br />specifications and any necessary modification thereof approved by the State. No <br />payment will be made under this contract until the Contractor has submitted project <br />plans and specifications and said project plans and specifications are approved <br />by the State, The above mentioned time may be extended by the State if such time <br />i:.; insufficient because of acts of God or other acts or circumstances beyond the <br />control of the Contractor. <br /> <br />- <br /> <br />2. Convpy or cause title to be conveyed by deed or other proper conveyance <br />to the State, the following pvrLions of the proposed project facilities: <br /> <br />(a) A steel pipe, 5/16 inch thick, 48 inch diameter 269+ feet lonq, <br />lnSloe the ex~sting reservoir rock outlet tuonel. <br /> <br />(b) A 42 inco diameter ring jet throttling valve, connected to the <br />downstream end of the pipe described under (a), <br /> <br />(cl Appurtenances and controls necessary for the operation of the <br />system as described in (a) and (b), <br /> <br />(d) Two 48 inch diameter reservoir outlet gate valves (repaired), <br />located at the outlet works of the existing dam. <br /> <br />(c) ^ 12+ foot high 6000+ cu. yd. coffcrdufil to be constructed [or <br />repair purposes within the reservoir basin.
