(Reach One extending from the upstream limit of the Project located at the
, Federal aCiuisition line of the Chatfield Lake Project to the site of a
neH channel control vieir to be located approximately due east of the
street named Fairlolay Lane in the Tmm of Columbine Valley; Reach Two
extending from that same Heir to the present ~vest Oxford Avenue Bridge
Crossing; and Reach Three extending from that bridge crossing to the
downstream limit of the Project located at the present West Hampden Avenue
Bridge Crossing) for the purpose of locating individual measures to be
.implemented; and
WHEREAS, the State and the Government fully understand that this
agreement pertai~s only to Reach One of the Project, the State fully

inte~ds to activ~_) pu~s~e funding to enable the State to enter into a
subsequent agreement for Reaches ~vo and Three of the Project; and
\'!HEREAS, the State, through the Colorado Water Conservation Board,
hereby represents that it has the authority and capability to furnish the
non-Federal cooperation required by the Federal legislation authorizing
the flood control works and by other applicable laH; and

WHE~~S, this agreement supersedes and rescinds any and all prior
agreements and assurances that the parties to this agreement have previ-
ously entered into in regards to the subject matter of this agreement.
NOW, THEREFORE, the parties agree as folloHs:
L. The State agrees that it shall fulfill the requirements of non-

Federal cooperation, to-loli t:
a. Provide without cost' to the United States all land, easements,
and rights-of-way necessary for construction of the improvements for.
Reach One and, in consideration of the Federal participation outlined
under Paragraph 3 of this contract, provide lands and interests
