<br />. <br /> <br />. <br /> <br />(3) <br />decent, safe, and <br />displaced persons <br /> <br />IVi thin a reasonable period of time prior to displa~ement, <br />sanitary replacement dwellings will be available to: <br />in accordance with Section 205(c)(3) of said Act; <br /> <br />., <br />.. <br /> <br />(4) In acquiring real property it will be guided, to the <br />greatest extent practicable under State law, by the land acquisition policies <br />in Section 301 and the provisions of Section 302 of said Act; <br /> <br />(5) Property owners will be paid or reimbursed for necessary <br />expenses as specified in Section 303 and Section 304 of said Act. <br /> <br />(g) Contribute or cause to be contributed funds toward payment of <br />construction costs of the improvements equal to the costs of those features <br />of the improvements which are desired by local interests but are not required <br />for flood control. <br /> <br />(h) Assume responsibility and to pay damages, if necessary, in the <br />event of failure to perform in accordance with Section 221 of Public Law <br />91-611. <br /> <br />'f' <br /> <br />2. In consideration of the fulfillment of the foregoing requirements by <br />the State, the .United States agrees to construct the required channel <br />improvements as authorized by the laws of the United States and described on <br />the first page of this contract; provided, however, that the performance of <br />any obligation or the expenditure of any funds by the Government under this <br />contract is contingent upon Congress making the necessary appropriations and <br />funds being allocated and made available for the work described herein. <br /> <br />, <br /> <br />3. The State hereby gives the Government a right to enter upon, at <br />reasonable times and in a reasonable manner, project lands which the State <br />owns or cont rols, [or access to Reaches Two and Three for the purpose of <br />inspection and for the purpose of repairing and maintaining Reaches Two and <br />Three if such inspection shows that the State for any reason is failing to <br />manage, operate, repair, and maintain the flood control works in accordance <br />with the assurances hereunder and has persisted in such failure after a <br />reasonable notice in writing by the Government delivered to the Director of <br />the State's Water Conservation Board. No repair and maintenance by the <br />Government in such event shall operate to relieve the State of responsibility <br />to meet its obligations as set forth in Paragraph 1 of this Agreement, or to <br />preclude the Government from pursuing any other remedy at law or equity. <br /> <br />4. This Supplemental Agreement is subject to the approval of the <br />Secretary of the Army and shall not be valid until it shall have been <br /> <br />3 <br />
