<br />THIS CONTRACT, made this 1st day of Februarv 1981. by and between the
<br />State of Colorado for the pse and benefit of the Department of .1 Natural Resources
<br />(Colorado Water conservation Board)
<br />hereinafter referred to as the State, and "2 the Platte Canvon Water and Sanitation District,
<br />333 SCuth Bannock Street, Enqlewood, COlorado 80110
<br />hereinafter referred to as the contractor,
<br />
<br />WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made
<br />available and a sufficient unencumbered balance thereof remains a(!/~ fl/fayment in ~und Numbe.r 4008 ,
<br />G/L Account Number 560lX, Contract Encumbrance Number :2, and
<br />
<br />WHEREAS, required approval, c1e8rance and coordination has been accomplished from and with appropriate
<br />agencies; and
<br />
<br />WHEREAS. ., pursuant to the provisions of 37-60-119, COlorado Revised
<br />Statutes 1973, as amanded, the State is authorized to construct certain water
<br />projects for the benefit of the people of the state of COlorado; and
<br />
<br />WHEREAS, pursuant to the provisions of 37-60-122, COlorado Revised Statutes
<br />1973, as arrended, the COlorado General Assembly authorized to be constructed
<br />the Chatfield Project Channel IItproverrent fran such funds as nay becorre
<br />available to the Colorado Water ConseJ:Vaticn Board constnK':tion fund; and
<br />
<br />WHEREAS, pursuant to Senate Bill 537, enacted by the COlorado General
<br />Assembly during the 1979 regular session and duly signed into law, there was
<br />appropriated to the Colorado Water Conservation Board the sum of $2,500,000
<br />to provide the non-federal participation in the construction of the Olatfield
<br />Project Channel IItproverrent; and
<br />
<br />WHER.EAS, the State has entered into an agreement with the United States of
<br />!\merica, represented by the Corps of Engineers on Septerrer 7, 1977, attached
<br />hereto as Exhibit "A"; and
<br />
<br />WHEREAS, the above agreerrent between the State and the lliited States of
<br />America, represented by the Cbrps of Engineers, has been anended by Supplerrental
<br />Agreement Number 1, dated January 29, 1980, attached hereto as Exhibit "B"; and
<br />
<br />WHEREAS, pursuant to the provisions of the Supplerental Agreerrent Number 1,
<br />the State agrees to perfonn without cost to the United States, in conjunction
<br />with furnishing rights-of-way, all necessary rem::>va1 or alternation of existing
<br />buildings or other inproverrents and all necessary a1temations to bridges
<br />(except railroad), roads, streets, sewers and other utili ties; and
<br />
<br />l'iIJEREAS, the construction of the Chatfield Project Channel IItprovement will
<br />require the installation of a new discharge line, at a lo.ver elevation, extending
<br />from an enlarged sewage lift station on the west bank of the SOuth Platte River
<br />to an existing trunk line sewer on the east side of the South platte; and
<br />
<br />WHEREAS, the Contractor has installed the discharge line, at,his own ex-
<br />pense, for a total cost of Fifty-Five Thousand Fi va Hundred Ninety-one Dollars
<br />Fifty-Two Cents ($55,591.52) which cost includes the sum of Fifty--Thousand
<br />Eighty-1\-.<) Dollars Fifty cents ($50,082.50) payment to the COntractor and the
<br />sum of Five Thousand Five Hundred Nine Dollars 1\-.<) cents ($5,509.02) for
<br />engineering fees; and
<br />
<br />WHEREAS, the COntractor has requested rein1burserrent of the cost of thJ
<br />installation of the discharge line in a letter dated August 27, 1979,whicb
<br />letter is attached hereto as Exhibit "e"; and
<br />
<br />WHEREAS, the Contractor is a Water and Sanitation District within the State
<br />of Colorado i
