We have included them within the <br />report and sent a copy to t~e Director of the Colorado Water <br />Conservation Board. The Articles of Incorporation are not yet "gned. <br />The State of Colorado Is revlewi~g the Articles and we, the Ditch <br />Company wi I I provide the signed ,opy of the Articles of Incorporation <br />upon request. <br /> <br />c. Powers and authorities of or~anization <br /> <br />1. Right to eminent domain - The DeWeese Dye Ditch company, to any of <br />the Directors knowledge and according to the by-laws, has no right to <br />eminent domain. <br /> <br />Z. Taxing or Assessing Authority - Article V, Section Z, of the DeWeese <br /> <br />Dye Ditch Company by-laws stipulates that the Board of Directors shall <br /> <br />recommend the annual assessment to be voted on by al I shareholders at <br /> <br />our annual meeting. <br /> <br />3. Authority to enter contractuai arrangements.
