NATIONWIDE GENERAL PERMITS
WESTERN COLORADO

A. SPECIAL CONDITIONS. The ~ollowlng special conditions must be
~ollowed In order ~or the nationwIde permIts to be valid.
FaIlure to comply wIth a condition means that the work must be
authorIzed by an Individual or regional general permit Issued by
the DIstrIct Engineer.

1. That any dIscharge o~ dredged or ~Ill material will not
occur In the proxImIty of a public water supply Intake.

2. That any dIscharge o~ dredged or ~Ill materIal wIll not
occur In areas o~ concentrated shell~lsh production unless the
discharge Is direct lyre I ated to a she ll~ ',Sh harvest I ng act I v I ty.

3. That the activIty wIll not JeopSrdlze a threatened or
endangered species as Identl~led under the Endangered Species
Act, or destroy or adversely modl~y the critical habitat o~ such
species.

.. That the activity shall. not slgnl~rcantly disrupt the
movement of those species of aquatic' 'lIfe Indigenous to the
waterbody (unless the primary. purpose of the fill Is to Impound
water) .

5. That any dIscharge of dredged or ~Ill material shall
consist of suitable materIal free of toxic pollutants In toxic
amounts.

6. That any structure or fill authorized shall be properly
maintained.

7. That the activIty will not occur In a component of the
National WIld and Scenic River Systeml nor In a river officially
designated by Congress as a "study river" for possible Inclusion
In the system, while the river Is in an officIal study status.

8. That the actIvity shall not cause an unacceptable
Inter~erence wIth navigation.

9. That, If the actIvity may adversely a~~ect historic
properties which the National Park Service has lIsted on, or
determined elIgible ~or listing on, the National RegIster o~
Historic Places, the permittee will notl~y the district engineer.
I~ the district engineer determines that such historic properties
may be adversely a~~ected, he will provIde the AdvIsory Council
on Historic Preservation an opportunity to comment on the e~~ects
on such historic properties or he will consider modl~lcatlon,
suspension, or revocation In accordance with 33 CFR 325.7.
Furthermore, that, I~ the permittee be~ore or during prosecutIon
of the work authorized, encoun~ers a historIc property that has
not been listed on the National RegIster, but whIch may be
