22

Feasibility Report for Dam Safety Modifications to DeWeese Dam
April 22, 1997

5. INSTITUTIONAL CONSIDERATIONS

5.1 COLORADO DIVISION OF WILDLIFE

For the last several years, Ihe Colorado Division of Wildlife (CDOW) has leased the reservoir
and surrounding Company property on an annual basis for the purpose of developing a recreation
area at the reservoir. The CDOW has developed the area for bank and small boat fishing, as well
as picnicking. Overnight camping and water skiing are not permitted, The Company and the
CDOW are currently in the process of negotiating a long-term lease arrangement for recreational
use of the reservoir. Historically, lease payments made by the CDOW have been included in the
annual operating budget of the Company.

Construction of the dam safety modifications of Alternative No. I or Alternative No, 2 would
have no long-term impact on the recreational use of the reservoir. Alternative No, 3 (no-action)
would be expected to result in a significant negative effect on the recreational uses of the
reservoir due to reduced reservoir depths and shorelines, and could possibly eliminate all present
recreational uses.

During construction of the dam safety modifications, some temporary conditions may adversely
affect recreational uses of the reservoir, These conditions could include, but are not limited to,
the following:

I, Additional drawdown of the reservoir during construction to reduce the potential
for flooding damage to the work in progress;

2, Increased noise from construction activities; and

3, Increased traffic activity in the vicinity of the reservoir from construction workers
and material suppliers,

In the interests of public safety, it may be appropriate to restrict or suspend recreation activities
at the reservoir during all or a portion of the project construction, In any case, timely
communication of project plans and schedules with the CD OW will be appropriate,

:m GEl Consultants, Inc.

96006\RE.PORTS\FEAS\TEXT.NEW

I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
