These objections resulted in tetms and conditions that limit monthly, maximum
annual and 10-year running total as summari~ed in Table II-B.

TABLE II-B

MONTHLY liMITATIONS
TERMS AND CONDITIONS OF CASE NQ 82CW425 AND 87CW301

Apr
May
Jun
Jul
Aug
Sep
Oct

Lewis &
Strouse
(100 inches)
(AF)
o
86
100
100
89
56
45

Maximum Annual
Maximum 10-year Running Total

315
1695

Warrior 3.125 Shares
Direct
Flow
Ootion
(AF)
7.2
18.1
28.1
21.2
25.8
15.9
8.4

105
700

Storage
Ootion
(AF)
5.0
12.5
15.0
15.0
15.0
8.8
6.2

65
461

For the Warrior direct flow water rights, the winter return flow obligations of 8 percent will be
required. For the storage scenario, the retull1 flow obligations are equal to 12 percent for the
Warrior Ditch and 18 percent for the Lewis anCl Strouse Ditch. As previously stated, these retum
flow obligations would bypass Morrison's Bear Creek headgate and be diverted by the Harriman
Ditch and released to the Soda Lakes Reservoirs pursuant to an agreement with the Denver
Water Board.

Sewage effluent attributable to the Warrior direct flow water rights in Case NQ 82CW425 and
87CW301 can be reused to replace concurrent return flow obligation or reused elsewhere, not
to exceed 50% of the total amount diverted by the Warrior shares. Another restriction to the
reuse of this effluent is the amount cannot exceed the product of the total measured sewage
effluent and the sum of the amount of water diverted by the 3.125 shares of the Warrior Ditch

7O-{lSO.03S:MSTR-PLN

II-4
