<br />, .'.. WHEREAS, authority exists in the Law and Funds have been budgeted, tlPpropriated and otherwise made
<br />available and a sufficient unencumbered balance thereof. remains available for payment in Fund Number 1001 .
<br />; G/L Account Number 52157, Contract Encumbrance Number C 153178; and .

<br />WHERE~S, required approval, clearance and coordination has been accompli'shedJrom and with appropriate
<br />agen~ies;'and
<br />
<br />WHEREAS," the parties hereto have conducted a j oint, feasibility
<br />study of the Greetville project and have found that such a project is
<br />".> economically' feasible; and
<br />
<br />'WHEREAS, the State, through the Colorado Water Conservation Board,
<br />,has agreed to construct a 'portion of said project; and
<br />
<br />WHEREAS, pursuant to House Bill No, 1266 ,Fiftieth,General Assembly'
<br />of the State of Colorado, duly enacted by the Colorado General Assembly
<br />and approved by the Governor of the State of Colorado, there was appro-
<br />priated to the Colorado Water Conservation Board the sum of Sixty
<br />Thousand Dollars, ($60,000) for construction of a portion of the Greet-
<br />ville project; and
<br />
<br />WHEREAS, the Contractor'has ~vailable from its own 'sources and
<br />:'.:,,~ from a loan and grant approved by the Farmers' Horne Administration of
<br />;];...,'the United States sufficient funds to construct the 'remainder of the
<br />,;j):r;-W '-'project'.".,:,. ,~.

<br />. covenants, herein contained, it is agreed by the parties hereto as. .

<br />", A. Contractor agrees that it will:
<br />
<br />':,'~",1." Cause 'said project to be constructed within one year of
<br />the date of this contract in accordance with the project
<br />'plans and spgcifications and any necessary modificati.ons
<br />thereof prepared by it as approved by the State; unless such,
<br />time is ,extended by the State, or unless such time is
<br />insufficient because of acts of God or other acts or failure
<br />'to act he yond the control of the ,Contractor.

<br />2. Permit periodic inspection of construction by the autho-
<br />rized representatives of the St~te during construction and
<br />, permit the State to, review and approve or disapprove any
<br />,:contracts for the construction of the project.

<br />, 3. Without expense to the State, manage, operate' and maintain
<br />the projeGt system continuously in an 'efficient and economical
<br />" ,manner, and assume all legal liability for such management,
<br />:".operati.on and maintenance. .

<br />4. Make the services of said project available ~ithin its
<br />.capacity to all persons in Contract~rls service area without
<br />discrimination as to race, co1ar, religi.on .or natural .origin
<br />at reas.onable' charges, including assessments, taxes, or fees in
<br />accardance w~th a schedule .of such charges, whether for one or
<br />more classes of service, formally adopted by the Contractor
<br />. through its board .of. direc-tors, as may be modified fr.om time
<br />to time by Contractor. The initial rate schedule must be,
<br />appraved by_ the State. Thereafter, the Contractor may make
<br />such modifications to the rate schedule as the Contractor
<br />dee,rns necessary to efficiently and economically provide for
