Ioannides <br />Chief Project Planning and Construction Section <br />Colorado Water Conservation Board <br />Department of Natural Resources <br />823 State Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br /> <br />RE: Contract Between the Town of Larkspur , Colorado ,and <br />the Colorado Water Conservation Board for Improvement <br />of Larkspur's Water Facilities <br /> <br />Dear Mr. Ioannides: <br /> <br />I am writing in response to your letter of September 30, 1985, in <br />which you requested that the Town provide you with an attorney's <br />opinion with respect to the various items set forth in that letter. <br />As Town Attorney, I have been asked to furnish you with such an <br />opinion: <br />I. The person signing for the Town is Ann Trueblood, the Mayor <br />of the Town of Larkspur, an official duly elected. <br /> <br />2. Mayor Trueblood has the authority to bind the Town and the <br />contract has been validly approved by the Town's governing <br />body. A copy of the particular minutes of the meeting <br />approving the contract shall be furnished to you under separate <br />cover. <br /> <br />3. A special election was held to obtain voter <br />the Town incurring additional indebtedness. A <br />election results, certified by the Town Clerk <br />herewith. <br /> <br />approval for <br />copy of the <br />is enclosed <br /> <br />4. There are no prov lSlons in the Town Charter or any Town <br />Ordinance which would prevent the contract from binding the <br />Town. <br /> <br />5. The contract will be valid and binding against the Town if <br />validly entered into by the state. <br /> <br />Also find enclosed a copy of the Notice of Special Municipal <br />Election. <br />
