The certificate of the secretary on personal service <br />or of the mal ling such notice and demand entered upon the record <br />.book cf the c""'pany shall constitute prima facie evidence and <br />be sufficient to authorize the order or forfeiture mentioned <br />herein. <br /> <br />And immediately upon the making of any order forfeituring, <br />and declaring subject to sale, any stock and the amount due <br />thereon, the secretary shall prepare and sign a notice of the <br />sale which notice shall be set forth in substance the <br />order of the Board of Directors forfeituring the stock and shall <br />designate the time, place and manner of the sale which notice <br />shall be published in a weekly newspaper published at Fort <br />Morgan, Colorado, at least ten days prior to such sale. <br /> <br />The Secretary shall also mail in the Post Office a similar <br />notice of said proposed sale addressed to the delinquent <br />stockholders at his last known Post Office address with posta~e <br />prepaid thereon; and the certificate of the Secretary shall be prima <br />facie evidence of the fact of the due publication of the notice of <br />the sale and of the fact of the mailing of such notice. He <br />shall also keep among the files of his offices the published <br />affidavit of each such notice as he has provided. <br /> <br />Section 4. All sales provided for in these by-laws <br />shallibe at public auction by the Secretary and all proceeds <br />thereof, over and above the amount due on the stock sold <br />including interest and cost and expense of the sale shall be <br />paid to the delinquent stockholder, provided, however, that the <br />Board of Directors at their option instead of forfeiturin~ <br />and causing the sale of any such stock may cause the amount <br />so due to be collected by suit. <br /> <br />ARTICLE VI. <br />Water Deliveries <br /> <br />Section 1. l.Jhen water is stored in the reservoir of <br />the company, it shall be drawn therefrom for distribution to the <br />parties entitled thereto at such times as the Board of Directors <br />may provide during the irrigation season, and the water allowed <br />to flow from said reservoir shall be distributed pro rata <br />among the parties entitled thereto, who shall have paid all <br />assessments regularly made and payable according to the interest <br />of each held and owned therein; provided, however, that the <br />company shall not be required to run any water out of said <br />reservoir at any time without having first been given at least <br />one week's notice of the time and the amount which any of the party <br />or parties entitled thereto shall require; and provided, further, <br />that the company shall not be required to deliver at anyone time <br />less than one hundred (100) cubic feet of water per second of time. <br /> <br />The delivery of all of said w.ater shall be ",ade direct into the <br />South Platte River only and subject to the conditions as provided <br />in this section in time and amount as required for the use of <br />the person entitled thereto pro rata in such amount as the <br />company can safely deliver without danger to its said property, <br />provided, however, that where the water is desired by different <br />consumers entitled thereto, to be taken from said river below said <br />company's outlet; the company reserves the right to run the same in <br />sections, that is delivering to certain consumers for certain <br />ditches on certain days and certain other consu~er for other ditches <br />on other days: the amount to which each is entitled; sdjusting <br />the matter as far as possible as in the judgment of the Board of <br />Directors will be the most advantageous for all consumers therefrom. <br />
