<br />WHEREAS, required approval, clearance and coordination has been accomplished from and,with' appropriate
<br />agencies; and
<br />
<br />WHEREAS, .;. pursuant to the provisions. of 37-60-119, Colorado Revised
<br />Statutes 1973, as ~mended, the Colorado Water Conservation Board is
<br />authorized 'to construct certain water projects for the benefit of the
<br />people of the State of Colorado; and
<br />
<br />WHEREAS, Beaver Park Water, Inc. has mgde application to the
<br />Colorado Water Conservation Board for the construction of a water
<br />project fqr the purpose of improving its irrigation system; and
<br />
<br />WHEREAS, the Contractor is a professional engineering firm within
<br />the State of Colorado and has previously done considerable water-
<br />related work for- Beaver Park Water, Inc. and'various other irrigation
<br />'co~panies in Colorado;
<br />
<br />NOW THEREFORE, it is herebyggreed that
<br />
<br />-I. The Contractor agrees 'to prepare a feasibility report directed
<br />to the problem of improving the irrigation system of Beaver Park Water,
<br />Inc. in accordance with proposals for project ,feasibility report pre-
<br />pared by the Contractor and gpproved by the Colorado Water Conservation
<br />Board, received February 22, 1979 and March 5, 1979, which proposals
<br />are.attached hereto as Appendices A and B and made a part of this
<br />contract.
<br />
<br />2. Fifteen (15) copies of the report called for in this contract
<br />shall be furnished to the State not later thgn August 15, 1979, unless
<br />such time'is ex~ended by mutual agreement of the parties hereto.
<br />
<br />3. As' compensation for the services of the Contractor, the State
<br />agrees to pay the Contractor the sum of Three Thousand Two Hundred Fifty
<br />Dollars ($3,250) in the manner following:

<br />Sixty percent (60%), to wit, One Thousand Nine Hundred Fifty
<br />($1,950)' of the total amount due in two (2) monthly installments
<br />Hundred Seventy-Five Dollgrs ($975) egch, commencing on June 1,

<br />b. The rerna1n1ng forty percent (40%), to wit, One Thousand Three
<br />. Hundred Dollars ($1,300) within thirty (30) days following receipt gnd
<br />ac~eptgnce of the. written report specified in paragraph 2 of this
<br />contract.

<br />4~ rhe total cost of services to be rendered by the Contractor
<br />'is Six Thousand Five Hundred Dollars ($6,500) and Beaver.Park Water, Inc.
<br />'shall pay the sum of Three Thousgnd Two Hundred Fifty Dollgrs ($3,250)
<br />as agreed.to by letter dated March 3, 1979, which letter is hereby
<br />attache'd hereto' and made a part of this contract as Appendix C; and -in
