Dear Mr. Briscoe:

On September 4. 1986, the above referenced structure was inspected in
accordance with Section 37-87-107. C.R.S. (1973)(1986 Supp.). which assigns to
the State Engineer responsibility for the determination of the safe storage
level for the reservoirs within this state.

During the inspection. several conditions were noted that threaten the
long-term safety of the dam. They are as follows:

1. The slide on the downstream slope still has not been repaired.

2. The emergency spillway capacity is inadequate.

In the interest of public safety. the storage restriction to three feet
below the spillway crest is continued. By copy of this letter, the Division
Engineer is directed to enforce this restriction, but the primary responsi-
bility is yours in accordance with Section 37-87-107. C.R.S. (1973)(1986
Supp.). This restriction is the minimum action you can take to improve the
safety of the dam. Additional actions may be necessary based upon the recom-
mendation of your engineer. You are reminded that as owner. you are liable
for the safety of this structure and that these minimum requirements do not
relieve you of that liability.
