Div. 4, Dam 1.0. 400404 <br /> <br />DUE DATE: January 1, 1985 <br /> <br />SUBJECT: Restriction of storage to 3 feet ~21ow spillway crest. <br /> <br />Dear Mr. Br iscoe: <br /> <br />On August 17, 1984, the above referenced structure was inspected in <br />accordance with Section 37-87-107 C.R.S. (1973) (amended 1984), which relates <br />to the safety of dams. This statute assigns the resi>onsibility to the State <br />Engineer for the determination of the safe storage level for reservoirs within <br />this state. A copy of the inspection report is attached for your information <br />and use. <br /> <br />The inspection report describes conditions which seriously threaten the <br />safety of the dam and which. could lead to its failure if the reservoir is <br />operated at full storage. Due to these conditions, storage is hereby <br />restricted to a level three feet below the crest of the spillway. By copy of <br />this letter, the Division Engineer is directed to enforce this restriction. <br />However, as owner, you are liable for the safety of this structure, and are <br />reminded that this restrictio~'is the minimum action you can take to irn?rove <br />the immediate safety of the dam. Additional restriction or other action may <br />be necessary based upon the recorrmendation of your engineer, in order to <br />further protect yourself from liability. <br /> <br />If you wish to use the full storage capacity of the reservoir, you must <br />have plans for repair of the slide on the downstream slope of the dam prepared <br />by an engineer registered in the State of COlorado, and submit them to this <br />office for approval. Upon approval of the plans and completion of repair <br />work, the storage restriction will be re-evaluated. <br />
