' <br />' T^later Rights <br />Conditional water rights for the Yamcolo Reservoir have <br />been obtained by the Colorado River Nater Conservation Dis- <br />' trict in Civil Action No. 3538 in the District Court for <br />Routt County as follows: <br />t For storage in the proqosed Yamcolo Reservoir - <br />6531.9 acre-feet <br />' <br />LJ <br />t <br />1 <br />fl <br />1 <br />1 <br />' <br />1 <br />1 <br />L� <br />' <br />' <br />1 <br />For direct flow diversion from the Yamna P.iver - <br />69.17 cfs <br />For direct flow diversion from Coal Creek to Yamcolo Reservoir- <br />30.0 cfs <br />The above decree was entered in the District Court idarch <br />30, 1964 with an appropriation date of February 26, 1963. <br />The Board of Directors of the Colorado River �vater <br />Conservation District is prepared to assign these water rights <br />to the Upper Yamoa FVater Conservancy District without cost as <br />soon as they are prepared to proceed with construction of the <br />Yamcolo Reservoir and Coal Creek Feeder Canal. In addition <br />the Board will probably be willing to transfer a portion of <br />their storage decree in Pleasant Valley P.eservoir to Yamcolo <br />if and when it is required. <br />The Yamcolo rights are junior in nriority to a number of <br />other conditional decrees in the Yampa Valley, including those <br />of the Four Counties Water Users Association for diversion of <br />tributaries of the Yampa over Rabbit Ears Pass, and storage <br />rights held by the Colorado River [�ater Conservation District <br />ior Bear, and Juniper Reservoirs. <br />With regard to the Four Counties rights, senior decrees <br />on the tributaries themselves (i.e. Harrison, Walton and Fish <br />Creeks) will nearly always call out Four Counties before a call <br />cones on the main stem of the Yampa. <br />�aith regard to other main stem storage decrees held by <br />the River District, their sole ourpose is to provide for dev- <br />elopment of water resources in the basin as a whole, and such <br />stipulations of priority or transfer as are necessary to pro- <br />tect the water resources of the basin will be made by the River <br />District at the anpropriate time. <br />IV - 13 <br />' <br />
