H"llIireJ <lIJpwv;ll. clearance :lnd coordination has been :JccompJished from and with appropriate <br />agcl1d('~: alld <br /> <br />WIlEREAS. ., pursuant to the prov~swns of 37-60-119, Colorado Revised <br />Statutes 1973, as amended, the Colorado Water Conservation Board is <br />authorized to construct certain water projects for the benefit of the <br />people of the State of Colorado; and <br /> <br />WHEREAS, the town of Hayden has made application to the Colorado <br />Water Conservation Board for the construction of a water project for <br />the purpose of imp>oving its municipal water supply; and <br /> <br />WHEREAS, the Contractor is a professional engineering firm within <br />the State of Color~do and has previously done considerable water-relateJ <br />work for the Town of Hayden and various other municipalities in Colo- <br />rado; <br /> <br />NOW THEREFORE, it is hereby agreed that <br /> <br />1. The Contr~ctor agrees to prepare a feasibility report directed <br />to the problem of improving the municipal water of the Town of Hayden <br />in accordance with a proposal for project feasibility report prepared <br />by the Contractor ~nd approved by the Colorado Water Conservation <br />Board, received Ja~uary 30, 1976, which proposal is attached hereto as <br />Appendix A and made a part of this contract. <br /> <br />2. Thirty (30) copies of the report called for in this contract <br />shall be furnished to the State not later than June 30, 1976, unless <br />such time is extended by mutual agreement of the parties hereto. <br /> <br />3. As compensation for the services of the Contractor, the State <br />agrees to pay the Contractor the sum of Two TPousand Three Hundred <br />Dolla>s ($2,300) in the manner following: <br /> <br />a. Sixty percent (60%), to wit, One Thousand Three Hundred and <br />Eighty Dollars ($1,380) of the total amount due in two (2) monthly <br />installments of Si~ Hundred Ninety Dollars ($690) each, commencing on <br />April 15, 1976. <br /> <br />\ <br />\ <br /> <br />b. The remaining forty percent (40%), to wit, Nine Hundred and <br />Twenty Dollars ($920) within thirty (30) days following receipt and <br />acceptance of the written report specified in paragraph 2 of this con- <br />tract. <br /> <br />4. <br />formance <br />approval <br /> <br />This contract is personal in nature ond assignment of per- <br />by the Contractor to another is proh~bited unless prior <br />in writing is granted by the State. <br /> <br />5.
