<br />WHEREAS, authority exists in the Law and Funds have been budge~d, appropriated and otherwise made
<br />available and a sufficient unencumbered balance thereof remains available for payment in Fund Number 4008 ,
<br />G/L Account Number 5763X, Contract Encumbrance Number 153311 ; and
<br />ABL Account Number 17630, Org. Uni.t 77-77-777,
<br />WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate
<br />agencies; and
<br />
<br />WHEREAS, the State and the Contractor dirt on August 1, 1979,
<br />enter into a contract and on September 1, 1981, and May 1, 1982,
<br />into amended contracts for State participatio~ in the construction
<br />of the Nunn water supply project for the benefit of the residents of
<br />the Town of Nunn, which contract and amended contracts are attached
<br />hereto as Exhibits ~, B, and C and are hereby incorporated herein;
<br />and
<br />
<br />WHEREAS, it was determined that a ten perc

<br />A. The Contractor agrees that it will:
<br />
<br />9. Purchase from the State all of the State's right, title, and
<br />interest in said project and any facilities tbereof at a total
<br />purchase price of Three Hundred Sixty-One Thousand Six Hundred
<br />Fifty-Three Dollars and Sixty Cents ($361,653.60), payable in forty
<br />(40) annual installments of Nine Thousand Forty-One Dollars and
<br />Thirty-Four Cents ($9,041.34) each, which first installment shall be
<br />due and payable on November 1, 1982, and yearlY thereafter until the
<br />entire principal sum shall have been paid. Said installment
<br />payments shall be made payable to the Colorado Water Conservation
<br />Board, payable at the off~ces of said board in Denver, Colorado.
<br />
<br />B. The State agrees that it will:
<br />
<br />1.' I\,ake available to the Contractor for the purpose of this
<br />contact the sum of TWO Hundred Four Thousand one Hundred Dollars
<br />($204,100). Said Two Hundred Four Thousand One Hundred Dollars
<br />($204,100) shall be made available to the Contractor in accordance
<br />with t1'!e following terms, schedUle and conditions:
<br />
<br />a. Beginninq with the monthly periOd commencing
<br />September 1, 1979, and for every month thereafter until
<br />said project has been completed, the Contactor shall
<br />prepare with the consulting engineer's help an estimate
<br />of the funds required from the State for proj ect
<br />construction during that month and shall forward said
<br />estimate to the State not less than fifteen (15) days
<br />prior to the beginning of such month.
