<br />WHEREAS, the Town of Nunn, Colorado has heretofore entered
<br />into a contract with the Department of Natural Resources (Colorado
<br />Water Conservation Board) of the State of Colorado, wherein the
<br />Department of Natural Resources loaned the Town of Nunn the sum
<br />of $361,653.60 to complete the installation and erection of addi-
<br />tional services to the water system of the Town of Nunn; and
<br />
<br />WHEREAS, the Town of Nunn agreed to convey by deed or other
<br />proper conveyance to the Colorado Water Conservation Board, Depart-
<br />ment of Natural Resources, State of Colorado, the following por-
<br />tions of the proposed project facilities as security for the re-
<br />payment of said sum of $361,653.60; and
<br />
<br />WHEREAS, the improvements to the water system to the Town
<br />of Nunn have been completed and the Colorado Water Conservation
<br />Board is now prepared to advance the remaining funds due under the
<br />contract to the Town of Nunn for payment of the balance of the
<br />costs of construction of said system; and
<br />
<br />WHEREAS, the Department of Natural Resources (Colorado Water
<br />Conservation Board) agrees in the contract entered into with the
<br />Town of Nunn to reconvey the portions of the water project required
<br />as security at this time at such time as the Town of Nunn shall have
<br />repaid the total sum of $361,653.60.

<br />NOW, THEREFORE, in consideration of the contract dated June 1,
<br />1982, amending contracts dated August 1, 1979, September 1, 1981,
<br />and May 1, 1982, and in consideration of the advancing of the sum
<br />of $361,653.60 to the Town of Nunn for the erection of additional
<br />water facilities to the Town of Nunn, the Board of Trustees of the
<br />Town of Nunn, by and through the Mayor and Clerk of the Town of Nunn,
<br />do hereby grant, bargain, sell and convey and by these presents do
<br />grant, bargain, sell, convey and confirm unto the Department of
<br />Natural Resources (Colorado Water Conservation Board), of the State
<br />of COlorado, all of the following described facilities, being a part
<br />of the water system of the Town of Nunn, Colorado, to-wit:

<br />A. A 100,000 gallon steel water storage tank located
<br />upon an easement to the following described prop-
<br />erty:
<br />
<br />Commencing at the Northwest corner of the South-
<br />west Quarter (SW%) of Section Fifteen (15), Town-
<br />ship Nine (9) North, Range Sixty-six (66) West
<br />of the 6th P.M., in WELD County, Colorado, and
<br />continuing thence East along the half section
<br />line 400 feet; thence South parallel to the West
<br />Section line of said section 15, 220 feet; thence
<br />West parallel to the half section line of said
<br />Section 15, 300 feet; thence South parallel to the
<br />West Section line of Section 15, 230 feet; thence
<br />West parallel to the half section line of Section
<br />15, 100 feet to the center of the County Road;
<br />thence North along the center of the County Road,
<br />450 feet to the point of beginning;
<br />
<br />B. A six-inch (6") diameter 2l!lO-foot water line on
<br />4th Street between Roosevelt and Washington
<br />Avenues, with all appurtenances;
<br />
<br />C. A six-inch (6") diameter 860-foot water line on
<br />Washington Avenue between 2nd and 4th Streets,
<br />with all appurtenances;
