<br />WHEJU::AS. . J pursuant to the provisions of 37-60-119, COlorado Revised
<br />statutes 1973, as aIrended, the State is authorized to construct certain water
<br />projects for the benefit of the peop:!.e of the State; and
<br />
<br />WHEREAS, the COntractor is a t<MJl in the State of Coloracb and wishes to
<br />undertake repairs of its municipal systan, hereinafter called the project,
<br />for the citizens of the TOYJrl of Hudson in \'.eld County, COlorado, at an
<br />estimated cost of Four Hundred Thirty-Five 'Ihousand Ibllars ($435,000); and
<br />
<br />WHEREAS, a feasibility investigation cf said project was conducted and
<br />it was found that such a project is econanically feasible; and
<br />
<br />WHEREAS, the State has agreed to construct said project and to sell the
<br />same to the Contractor upon mutually agreeable tenns and condi tions, subject
<br />to the approval of appropriations for that puqx:>se by the COlorado General
<br />Assanbly and the C,ovemor of the State of COlorado; and
<br />
<br />WHEREAS, pursuant to Senate Bill No. 69, Fifty-First C'xmeral Assembly of
<br />the state of COlorado, duly enacted by the COlorado General Assenb1y and
<br />approved by the G:>vemor of the State of Colorado, there was apprc;Jriated
<br />to the COlorado Water COnservation &::la.rd the sun of Nine HU!1dred Thousand
<br />Ibllars ($900,000) for construction of the Hudson project;
<br />
<br />NCW THEREFORE, in consideration of the mutual and dependent covenants
<br />herein contained, it is agreed by the parties hereto as follON's:
<br />
<br />A. The Contractor agrees that it will:
<br />
<br />1. Cause the construction of said project to be carpleted within
<br />~ (2) years of the date of this contract in acoordance with the project
<br />plans and specifications and any necessary rrodification thereof approved by
<br />the State. No paynents will be made lU1der this contract until the project
<br />plans and speicifications are aWro\-ed by the State. 'l'he above-rrentioned tine
<br />nay be extended by the State if such time is insufficient because of acts of
<br />(",ad or other acts or cirClJTiStances beyond the control of the COntractor.

<br />2. Conveyor cause title to be conveyed by deed or other proper
<br />conveyance to the Colorado Water Conservation Board, DepartJrent of Natural
<br />Resources, State of COlorado, the following portions of the proposed project
<br />facilities:
<br />
