<br />. <br /> <br />. <br /> <br />Consultant: Boyle Engineering Corp. <br />Agreement No. C150141 <br />Amount: $500,000 <br /> <br />Agency: CWCB <br />Agency No. PDA sfA 4- fttJ1 r / <br />Routing No. (? 0 <br /> <br />CONSULTANT AGREEMENT <br /> <br />STANDARD FORMA T - ST ATE FORM 6-AC-02-A (modifications for this agreement made by <br />Linda Bassi, Robert Bowers, Maggie Van Cleef & Jan //Iian) <br /> <br />THIS AGREEMENT made this June 4, 2003, by and between the State of Colorado, acting <br />by and through the Colorado Warer Conservation Board of the Department of Natural Resources, <br />hereinafter called the CWCB or State, and Boyle Engineering Corporation, 215 Union Blvd, Suite <br />500, Lakewood, Colorado 80228, referred to as the Consultant or Contractor. <br /> <br />Factual Recitals <br /> <br />1. Authority exists in the law, and funds have been budgeted, appropriated, and otherwise made <br />available, and a sufficient unencumbered balance thereof remains available for payment in Fund <br />Number 424, Appropriation Code CRS, GBL B141, Object Code 1920, Organization Code <br />YVYY, Contract Encumbrance Number C150141. <br /> <br />2. Required approval, clearance and coordination have been accomplished from and with <br />appropriate agencies. <br /> <br />3. The Colorado River Return Reconnaissance Study, authorized by SB03-110, Section 15, shall <br />consist of a reconnaissance-level study to address all physical, logistical, environmental, <br />financial, legal, and institutional aspects of the construction of a large-scale water delivery <br />system to carry water from the Colorado River near the Utah border to be utilized in the South <br />Platte, Arkansas, and Colorado River Basins, hereinafter referred to as Project. <br /> <br />4. The Consultant was selected and determined to be the most qualified, and fees negotiated in <br />accordance with the provisions of Section 24-30-1401, C.R.S. as amended. <br /> <br />NOW THEREFORE, it is hereby agreed that <br /> <br />ARTICLE 1. SCOPE OF WORK <br /> <br />The Consultant, in consideration of CWCB's promises hereinafter made, promises to perform and <br />accomplish all the work and services proposed, and in accordance with the terms and conditions set <br />forth in the scope of work description (Work) attached hereto and made a part hereof as Exhibit A, <br />Consultant shall undertake and perform the necessary work and services as is customarily done in <br />the professional practice of Architecture/Engineering/Consulting in the community for undertakings <br />of similar character, scope and magnitude. <br /> <br />ARTICLE 2. COMPENSATION <br /> <br />In consideration for the performance of the said work and services, the CWCB agrees to pay to <br />Consultant fees and charges not to exceed Five Hundred Thousand Dollars ($500,000). During the <br />term of this Agreement, the CWCB shall make monthly partial payments based on the Consultant's <br />billings. The amounts of all such partial payments shall be based upon the Consultant's certified <br />progress reports and billings covering the status of the Work and the percentages of the whole that <br />have been accomplished. <br /> <br />Page 1 <br /> <br />
