The enlargement of Elkhead Creek Reservoir for the emergency storage in <br />addition to the claim of the Colorado Game, Fish and Parks, must be obtained <br />through the courts. This is a legal matter which should be handled by your <br />attorney. We have enclosed with this letter a copy of the appl ication form <br />which must be completed along with a map showing the legal location of the <br />reservoir and submitted to the Water Clerk of the District Court in Steamboat <br />Springs, Colorado., The appropriation date will probably be a fairly recent <br />date, when the enlargement was first seriously contemplated. Once a conditionai <br />water rights is obtained, a biennial finding of reasonable dil igence on the <br />water right must be shown to maintain the water right in good standing until <br />the reservoir is completed and stores water. <br /> <br />We hope this letter provides you with the necessary information on which <br />to base your decision for involvement in the Elkhead Creek Reservoir with the <br />Colorado Game, Fish and Parks.
