The signature on behalf of the Mayor and the City <br />Council is that of Russell Lewis, the duly-elected Mayor <br />of the City of Manitou Springs. <br /> <br />2. That Mayor Lewis has the authority to bind the <br />City, and that the Second Contract Amendment has been validly <br />approved by the City Council of the City of Manitou Springs. <br />A copy of the Minutes of the meeting of Council at which such <br />approval was given is enclosed herewith, together with a copy <br />of the Resolution authorized and approved at the meeting re- <br />corded in the enclosed Minutes. <br /> <br />3. That the City Council of the City of Manitou Springs <br />has the authority to enter into the Contract Amendment without <br />a vote of i.ts residents as this Contract Amendment comes with- <br />in the "Water Supply Exception" of the Colorado Constitution, <br />Article XI, Section 1. <br /> <br />4. That there are no provisions in the Code of <br />Ordinances or in the Charter of the City of Manitou Springs <br />that prevents this Contract amendment from binding the City, <br />nor is there any other state or local law that prevents this <br />Contract Amendment from binding the City. <br />
