<br />-- -----. ---- -' .- - ----- - ____a - <br /> <br />2.0 DESCRIPTION OF SPONSORING ENTITIES <br /> <br />The Pagosa Area Water & Sanitation District (PAWSD) and the San Juan Water Conservancy District <br />(SJWCD) are the sponsoring agencies for this project. Information on each entity is presented below. <br />Information on the P A WSD is updated from the Preliminary Official Statement dated September 1992 <br />for $1,400,000 PAWSD General Obligation Bonds, Series 1992, prepared by Hanifen, Imhoff Inc. <br />SJWCD data was summarized from information supplied by this District. <br /> <br />2.1 PAGOSA AREA WATER AND SANITATION DISTRICT (PAWSD) <br /> <br />2.1.1 GENERAL <br /> <br />The PAWSD is a quasi-municipal corporation and a political subdivision of the State of Colorado <br />which was formed in 1977 pursuant to Title 32, Article 1, C.R.S. (the "Special District Act"), for the <br />purpose of providing water and sanitation facilities and services for the inhabitants of the District. <br />The District was established by order and decree of the district court in and for Archuleta County <br />following the filing and county approval of a service plan. The service plan consists of a financial <br />plan, including proposed funding, and a preliminary engineering survey detailing the proposed <br />improvements within the District; the filing of a petition for organization and the subsequent hearing <br />thereon approving said petition; and an approving election held within the proposed district. <br /> <br />2.1.2 DISTRICT POWERS AND AUTHORITY <br /> <br />The rights, powers, privileges, authorities, functions, and duties of the District are established by the <br />laws of the State of Colorado, particularly the Special District Act. This legislation enables the <br />District to: enter into contracts and agreements; sue and be sued; incur indebtedness with an election; <br />issue revenue obligations or refund outstanding indebtedness without an election; fix and from time to <br />time increase or decrease fees, rates, tolls, or charges for services, programs or facilities furnished by <br />or available from the PAWSD, and pledge such revenue for the payment of any indebtedness of the <br />District; certify the levy and direct the collection of ad valorem property taxes; acquire, dispose of, <br />and encumber real and personal property, and any interest therein, including leases and easements; <br />have the management, control and supervision of all the business affairs of the District, and the <br /> <br />2-1 <br /> <br />S9S\PAGOSAIS2,TXT <br />10/27/'12 mm <br />
