ArJo..J.-.$ ; and ~O S' <br /> <br />WHEREAS, required approval, clearance and coordination has been accomplished from and with appropriate <br />agencies; and <br /> <br />WHEREAS," pursuant to the provisions of 37-60-119, Colorado <br />Revised Statutes 1973, as amended, the Colorado Water Conservation <br />Board is authorized to construct certain water projects for'the <br />benefit of the people of the State of Colorado; and <br /> <br />WHEREAS, the Town of Carbondale has made application to the <br />Colorado Water Conservation Board for the construction of a water <br />project for the purpose of improving its municipal water supply; and <br /> <br />WHEREAS, the Contractor is a professional engineering firm <br />within the State of Colorado and has previously done considerable <br />water-related work for the Town of Carbondale and various other <br />municipalities in Colorado; <br /> <br />NOW THEREFORE, it is hereby agreed that <br /> <br />1. The Contractor agrees to prepare a feasibility report directed <br />to the problem of improving the municipal water supply of the Town of <br />Carbondale in accordance with a proposal for project feasibility report <br />prepared by the Contractor and approved by the Colorado Water Conserva- <br />tion Board, dated September 8, 1975, which proposal is attached hereto <br />as Appendix A and made a part of this contract. <br /> <br />2. Thirty,(30) copies of the report called for in this contract <br />shall be furnished to the State not later than January 15, 1976, unless <br />such time is extended by mutual agreement of the parties hereto. <br /> <br />3. As compensation for the services of the Contractor, the State <br />agrees to pay the Contractor the sum of Five Thousand Dollars ($5,000) <br />in the manner following: <br /> <br />a. Sixty percent (60%), to wit, Three Thousand Dollars ($3,000) <br />of the total amount due in two monthly installments of One Thousand Five <br />Hundred Dollars ($1,500) each, commencing on December 1, 1975. <br /> <br />b. The remaining forty percent (40%), to wit, Two Thousand <br />Dollars ($2,000) within thirty (30) days following receipt and acceptance <br />of the written report specified in paragraph 2 of this contract. <br /> <br />4.
