Box 41. <br /> <br />Blanca, CO 81125 <br /> <br />hereinafter referred to as the contractor/Contractor. <br /> <br />WHERPAS, authority exists in the Law and Funds have bel:.n budgeted, appropriated and otherwise maCe available and a sufficient <br />unencumbered balanct thereof remains available for pa;ntent in FU\1d Number ~ Organization ~ Appropriation ~ Program WfRC. <br />Object Code 67'6{ , Contract Encumbrance Number;.s::.J1S!> (,07 i.. ; and <br /> <br />WHERFAS, required approval, clearance and coordinatiC)n have been accomplished from and ",ith appropriate agencies; and <br /> <br />WHEREAS, pursuant to the provisiol:1S of 37-60-119 and 37-60-120, Colorado <br />Revised Statutes, the State is authorized to loan money for the construction of water <br />projects for the benefit of the people of th(: State provided that the Contractor assures <br />repayment of that money; and <br /> <br />WHEREAS, the Contractor is a duly constituted irrigation company in the State of <br />Colorado and it wishes to rehabilitate its Mountain Home Reservoir facility, hereinafter <br />sometimes called the project, for the benefit of the stockholders of'the Trinchera <br />Irrigation Company in Costilla County, Colorado, at an estimated cost of One Million <br />Dollars ($1,000,000); and <br /> <br />WHEREAS, on April 14, 1992, the parties entered into a feasibility report <br />contract. A feasibility investigation of said project was conducted and the State has <br />determined that such a project is technically and financially feasible; and <br /> <br />WHEREAS, on f' .,Li13:ne State and the Contractor entered into a <br />termination contract, attach (l hereto as EJrnibit A, which terminated the feasibility <br />report contract previously entered into between the parties, attached hereto as Exhibit <br />B; and <br /> <br />Page 1 of 13 Pages <br />
