Bartlett: <br /> <br />Reference is made to your project to remove and construct a new head gate structure <br />and rebuild a sand dam in the South Platte River_The project is located in Section 8, <br />Township 5 North, Range 54 West, Washington County, Colorado. <br /> <br />This letter is to inform you that the proposed work is the type of activity which is <br />included in the Section 404(f) exemption found at 33 C.F.R. Part 323.4(a)(3). Therefore, <br />the proposed work will not require a Department of the Army permit and will not require <br />further processing by this office. <br /> <br />Although a Department of the Army permit is not required for your proposed work, <br />this does not obviate your obligation to obtain any other Federal, state, tribal, or local <br />authorizations as may be required by law, <br /> <br />If there are any questions concerning this matter, please feel free to contact Me.
