WHEREAS. pursuant to the provisions of section 37-60-119.
Colorado Revised Statutes. as amended. the State is authorized
to construct certain water projects for the benefit of the
people of the State of Colorado; and

WHEREAS. the City of Longmont has made application to the
State for the improvement of its existing facility. such
improvement of the facility is hereinafter sometimes referred
to as the project; and

WHEREAS. the Contractor is a City within the State of
Colorado;

NOW THEREFORE. it is hereby agreed that:

1. The Cont~actor shall have a feasibility report prepared
and directed to the problem of improving the facilities of
McCall Lake. northwest of Longmont. Colorado. in accordance
with a proposal for a project feasibility report prepared by
the consulting engineering firm of Rocky Mountain Consultants.
Inc. (the Consultant). and approved by the State. dated
September 24. 19B7. which proposal is attached hereto as
Exhibit A and made a part of this contract.

2. Ten (10) copies of the final report called for in this
contract shall be furnished to the State not later than sixty
(60) days after the date of the contract. unless such time is
extended by mutual agreement of the parties hereto in writing.

3. As compensation for the services of the Contractor. the
State shall pay ~o the Contractor the sum of Four Thousand Nine
Hundred Seventy-five Dollars ($4.975) in the manner fol~owing:

a. Sixty percent (60\). to wit. Two Tho~sand Nine Hundred
Eighty-Five Dollars ($2.985) of the total amount due in two
(2) monthly installments of Fourteen Hundred Ninety-Two
Dollars'and Fifty Cents ($1.492.50) eBCn. commencing twenty
(20) days after the date of this contract.

b. The remaining forty percent (40\). to wit. Nineteen
Hundred NinetY Dollars ($1.990) within forty (40) days
following receipt and acceptance of the written report
specified in paragraph 2. of this contract.

c. The total cost of services to be rendered for the
Contractor by the Consultant is Nine Thousand Nine Hundred
tifty Dollars ($9.950) and the Contractor shall pay the sum of
Four Thousand Nine Hundred Seventy-Five Dollars ($~.975) as
agreed to by.letter dated September 24. 19B7. which is hereby
~tt8ched and made a part of this contract as Exhibit B; and in
mo event shall this payment be the liability of the State of
