Unit 77-77-777, WHEREAS. required approyal. clearance and coordinalion has been accomplished rrom and with appropriate agencies: and WHEREAS, pursuant to the provisions of section 37-60-l22(1)(c), Colorado Revised Statutes, as amended, the State is authorized to prepare feasibility reports on proposed water projects: and WHEREAS, the State, acting through the Colorado Water Conservation Board (CWCS), has determined thet it will cause to be prepared such a report on the rescoping and reformulation of a proposed West Divide project: and WHEREAS, the Contractor is willing to cause such a report to be prepared on behalf of and in cooperation with the State. NOW THEREFORE, it is hereby agreed that: 1. The Contractor shall obtain for the services of a consulting engineering firm (Consultant) to prepare a preliminary reconnaissance study on the reformulation of the West Divine project in accordance with the terms and condition~ of Appendix A, which is attached hereto and made a part of this contract. 2. Thirty (30) copies of the final report called for in Appendix A shall be furnished by the Contractor to the State not later than Marach 31, 1985, unless such time is extended by mutual agreement of the parties hereto in writing. 3. The total cost of the services to be rendered to the Contractor by the selected Consultant shall not exceed One Hundred Thousand Dollars ($100,000). 4. As compensation for the services of the Contractor, the State shall pay to the Contractor eighty percent (BO%) of the cost of the study, not to exceed Eighty Thousand Dollars ($80,000), in the manner following: a. Sixty percent (60%) of the total amount due in two (2) monthly installments commencing the day the Contractor executes a contract with a Consultant. b. The remaining forty percent (40%) within forty (40) days following receipt and acceptance of the written report specified in paragraph 2 of this contract. 5. The Colorado River Water Conservation District shall pay nineteen percent (19%) or Nineteen Thousand Dollars ($19,000), and the West Divide Water Conservancy District shall pay one percent (1%) or One Thousand Dollars (Sl,OOO), for the sum total of twenty percent (20%) or Twenty Thousand Dollars (S20,0001 toward the cost of the study.
