CONTRACT AMENDMENT

THIS CONTRACT. made this 8th day of August 1982- . by and between the
Slate of Colorado for the use and benefit of the Department of . 1 Natural Resources
(Colorado Water Conservation Board),
hereinilfter referred to as the Slate, and '2 the Colorado River Water Conservation District,
P. Q. Box 1120, Glenwood Springs, CO 81602; and the West Divide Water
hereinafter referred to as the contractor, Conservancy District, P.O. Box 1478, R~fle, CO 81650,

WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated and otherwise made
available and a sufficient unencumbered balance thereof remains available for payment in Fund Number 4008 .

WHEREAS. re4uired approval. clearance and cOQrdination has been accomplished from and with appropriate
agencies: and

WHEREAS, the State and the Contractor did on September 14,
1984, enter into a contract to have a feasibility report" prepared
for the proposed rescoping and reformulation of the West Divide
water project, which contract is attached hereto as Exhibit A and
is hereby incorporated herein; and

WHEREAS, because of technical difficulties, an engineering
firm to carry out the study could not be employed until the early
part of 1985; and

WHEREAS, the Contractor will be required to pay the
engineering firm a greater percentage of the feasibility study
monies following the execution' of the contract with the
engineering firm; and

WHEREAS, the State desires to ensure .the expeditious
completion of the feasibil.ity study;

NOW THEREFORE, it is hereby agreed that:

A. The original contract is amended as follows:

Page 1, paragraph 2, is amended to read:

2. Thirty (30) copies of the final r~ort called fo~ in
Appendix" A shall be furnished by the Contractor to the State
not later than December 31, 1985, unless such time is
extended by mutual agreement of the parties hereto in
writing.

Page l~ paragraph 4, is amended to read:

4. As compensation for the services of the Contractor,
the State 'shall pay to the Contractor eighty percent (80%)
of the cost of the study, not to exceed Eighty Thousand
Dollars ($80,000), in the manner following:

a. Eighty-four percent (84%) of the total. amount
due in three (3) monthly installments commencing the
day the Contractor executes a contract with a
Consultant.

b. The rernaing sixteen percent (16%) within forty
(40) days following receipt and.acceptance of the
written-report specified in paragraph 2 of this
contract.

B. The effective date of this amendment shall be September 1,
1985,

C. All the terms and conditions of the original contract shall
remain in full force and effect with the exception of the
amendments herein.
