Unit 77-77-777, <br /> <br />WHEREAS. required approval. clearance and coordination has been accomplished from and wilh appropriate <br />lIgC'nclt"5; and <br /> <br />WHEREAS. the State and the Contractor entered into a <br />contract dated April 25. 1988. Contract Encumbrance Number <br />C-153510 (hereinafter referred to as the "Original Contract"); <br />and <br /> <br />WHEREAS. the State and the Contractor entered into a <br />contract amendment dated January 6. 1989 (hereinafter referred <br />to as the "Amended Contract #111); and <br /> <br />WHEREAS. the State and the Contractor entered into a <br />contract amendment dated May 9. 1989 (hereinafter referred to <br />as the "Amended Contract #2"); and <br /> <br />WHEREAS. the State and the Contractor entered into a <br />contract amendment dated December 29. 1989 (hereinafter <br />referred to as the tlAmended Contract #311); and <br /> <br />WHEREAS. the State and the Contractor entered into a <br />contract amendment dated October 19. 1990 (hereinafter referred <br />to as the IlAmended Contract #4"); and <br /> <br />WHEREAS. because of even more unforeseen problems. the <br />Contractor's subconsultant attorney has been unable to <br />consummate all of the right-Of-way acquisitions required for <br />the Towaoc pipeline project within the time allowed in the <br />Amended Contract ~3. <br /> <br />Now Therefore. it is hereby agreed as foflows: <br /> <br />1. Consideration for this amendment to the Original <br />Contract. Contract Encumbrance Number C-153510. Contract <br />Routing Number 88412. dated April 25. 1988. consists of the <br />promises and agreements herein set forth. <br /> <br />2. This contract amendment is a suppl~ment to the Original <br />Contract. to the Amended Contract ~l. to the Amended Cohtract <br />#2. to the Amended Contract #3. and to the Amended Contract #4. <br />all shown as the Addendum. which is by this reference <br />incorporated and made a part hereOf; and all the terms, <br />conditions. and provisions thereof. unless specifically <br />modified herein are to apply to this contract amendment as <br />though they were expressly rewritten. incorporated. and <br />included herein. <br /> <br />3.
