Unit 77-77-777, <br />WHEREAS, re~uir~d apprt)~al. clearance and coordination has been accomplished from and with approp~ia'te <br />agi-ncies: and <br /> <br />WHeREAS, the State has entered into the Colorado Ute Indian <br />Hater Rights Final Settlement Agreement of Deeember 10, 1986' <br />(the "Agreement"), with the United States, the Ute Mountain Ute <br />Indian Tribe (the "Tribe"), and others, which Agreement <br />requires, inter alia, the State to construc~ a pipeline for the <br />transportation of water from the water treatment plant of the <br />city of Cortez, Colorado, to the Town of Towaoeon the Trib~'s <br />reservation in Colorado (the IIproject II) by December. 1988; and <br /> <br />WHEREAS. the Colorado Hater Conservation Board (tl)e "CHCB") <br />has been authorized by section 1 of chapter 230, session Laws <br />of Colorado 1986. to construct the Project in fulfillment ot <br />the Agreement; and <br /> <br />WHEREAS. the State is responsible for acquiring the lanQs <br />and interests therein (the "project lands") between the Cortez <br />water treatment plant and the boundary of the Tribe's <br />reservation which are needed for the Project; and <br /> <br />HHEREAS, the State desires to obtain by contract the <br />services needed to identify. appraise, negotiate for, and <br />,aequire. and perform all other tasks necessary to obtain. the <br />project lands; and ' <br /> <br />WHEREAS. every effort has been made by the State to prOCeed <br />with the Project as expeditiously as possible so that there <br />would be time to obtain these services through eompetitive <br />contracting procedures; end <br /> <br />,WHEREAS, changes in the Project's design asked for by the <br />Tribe. unantieipated complications in the selection of the <br />routing for the Project due to conflicts with the location of <br />existing utilities and PUblic rights-of-way. and the <br />unanticipated need to obtain easements across private lands, <br />for which the CWCB has hed to obtain legiSlative authority <br />during the 1988 session ~f the Colorado General Assembly have <br />caused substantial delay~ in the work on the Project; and <br /> <br />wHEREAS, the December. 1988. deadline for the Project's <br />completion cannot be met if competitive contracting procedures <br />where required are now followed to obtain the desired servic'es; <br />and <br /> <br />WHEREAS.
