<br />-~ <br /> <br />Task 9 - Condemnation <br /> <br />In case a settlement cannot be negotiated. request <br />will be made in writing to ewes to approve proceeding <br />with condemnation. eWeB shall respond with approval <br />or disapproval in fourteen (14) days. This act~on <br />assumes that ewes will first have obtained specific <br />powers of eminent domain tor the Towaoe Municipal <br />Project. A subcontractor who is an individual <br />attorney or a law firm. experienced in land <br />acquisition matters will be employed under the <br />direction of the consultant. The consultant shall <br />then make the necessary notices. ~erving of papers. <br />filings. and other documentations needed to actuate <br />the condemnations in the name of the State of <br />Colorado. and shall perform all other services <br />necessary to deliver deeds for all of said condemned <br />parcels to the State of Colorado. Specific written <br />power of attorney shall be given by the State of <br />Colorado for this activity. <br /> <br />b. Paragraph 18 of the Original Contract as modified <br />by paragraph 2 of Amended Contract #1 shall be further <br />modified to read as follows: <br /> <br />18. This contract shall remain in full force and <br />effect through December 31. 1990. unless sooner <br />terminated as provided herein. <br /> <br />4. The effective date of this contract amendment is as of <br />the date first above written. <br /> <br />5. In the event of any conflict. inconsistency. variance. <br />and incongruity between the provisions of this contract <br />amendment and the Original Contract. the provisions of this <br />contract amendment shall in all respects supersede. govern. and <br />control. <br /> <br /> <br /> <br />page ~ of ~ Pages <br />
