WHEREAS. reljuired approval. dearnnl"e and coordination has b~n accomplished frqm and with appropriate
agencies: and

WHEREAS, pursuant to the provisions of section ~7-60-119,
Colorado Revised Statutes. as amended. the State iSI a~thorized
to construct certain water projects for the benefit of the
people of the State of Colorado; and

WHEREAS, the Redlands Water and Power Company has made
application to.the State for the improvement of its) existing
facility. such improvement of the facility is hereinafter
sometimes referred to as the project; and '

WHEREAS, the Contractor is a non-profit corpora~ion within
the State of Colorado;

NOW THEREFORE, it is hereby agreed that:

1. The Contractor shall have a feasibility repprt prepared
and directed to the problem of improving the facilities of the
Redlands Water and Power Company in accordance ~ithl a proposal
for a project feasibility report prepared by the conSUlting
engineering firm of Western Engineers (the Consultapt) and
approved by the State, received June 29, 1988. whic~ proposal
is attached hereto as Appendix A and made a part ofl this
contract.

2. Fifteen (15) copies of the final report called for in
this contract shall be furnished to the State not later than
one hundred twenty (120) days after the date of thi~ contract,
unless such time is extended by mutual agreement ofl the parties
hereto in writing. I

3, As compensation for the services of the Contractor, the
State shall pay to the Contractor the sum of ThirtylTwO
Thousand Seven Hundred Fifty-Five Dollars ($32,755)~ in the
manner fOllowing:

a. Sixty percent (60\), to wit, Nineteen Thousa6d Six
Hundred Fifty-Three Dollars ($19,653) of the total amount
due in two (2) monthly installments of Nine Thopsand Eight
Hundred Twenty-Six Dollars an Fifty Cents ($9,B~6.50) each,
commencing thirty (30) days after the date of this contract.

b. The remaining forty percent (40\), to wit, ~hirteen
Thousand One Hundred Two Dollars ($13,102) with;in forty
(40) days following receipt and acceptance of the written
report specified in paragraph 2. of this contrapt.

4. The total cost of services to be rendered for the
Contractor by the Consultant is Sixty-Five Thousandl Five .
Hundred Ten Dollars ($65,510) and the Contractor shall pay the
sum of Thirty-Two Thousand Seven Hundred Fifty-Five: Dollars
($32,755) as agreed to by letter dated September 23~ 1988,
