WHEREAS, authority C'ldsts in the Law and Funds have been budgeted, appropriated and otherwise made
available and a sufficient unencumbered balance lhereof remains available for payment in Fund Number 4008

.WHEREAS, re4uircd approv:d, clearance and conrdinalion has heell accomplished from and wilh appropriate
agencies: and

WHEREAS. a contract was entered into on January 15. 1987.
Contract Encumbrance Number C-153485 (the Original Contract).
between the State and the Contractor: and

WHEREAS. construction bids received for the Grandview
Irrigation Project. Phase II. were lower than the State's
estimates; and

WHEREAS. for the above reason it is in the mutual interest
of the State and the Contractor to reduce the amount of moneys
made available to the Contractor for the Phase II construction
of this project; and

WHEREAS. repayments are in direct proportion to the amount
of money loaned; and

WHEREAS, the State and the Contractor find that they will
mutually benefit from the modification of the contract language
concerning the repayment. as set forth below.

NOW. THEREFORE, it is hereby agreed that:

1. This contract amendment is a supplement to the
Original Contract (Appendix A). which is. by this
reference. incorporated and made a part hereof. and all the
terms. conditions. and provisions thereof. unless
specifically modified herein. are to apply to this contract
amendment as though they were expressly rewritten.
incorporated. and included herein.

2. The only modifications. alterations. or changes in
the Original Contract shall be that Exhibit A and
paragraphs A.ll., C.l., and I. shall be deleted and in
their place Appendix B and the following paragraphs shall
be inserted:

A.II. Repay to the State the total principal sum of
Two Hundred Nine Thousand Nine Hundred Sixty-Eight
Dollars ($209,968), which includes the project loan
amount and interest at the rate of five percent (5\)
per annum, said repayment to be made in constanc
annual installments of Five Thousand Two Hundred
Forty-Nine Dollars and Twenty Cents ($5,249.20) each.
for forty (40) years, as shown in Appendix B. attached
hereto and incorporated by reference herein. which
first installment shall be due and payable on the
first day of the month next succeeding the month in
which the State determines that the project has been
substantially completed. and yearly thereafter until
the entire principal sum shall have been paid.
However. in the event the Contractor does not draw
