<br />. <br /> <br />. <br /> <br />(c) The United States shall not be a party to, or obligated in any <br />manner by, contracts entered into between the Contractor and other parties pur- <br />suant to t~is contract. <br /> <br />OPERATION AND MAINTENANCE OF PROJECT <br />WORKS - PAYMENT OF MISCELLANEOUS COSTS <br /> <br />11. (a) The Contractor, without expense to the United States, shall care <br /> <br />for, operate, and maintain the Project works in full compliance with the terms <br /> <br />of this contract, and in such manner that such Project works will remain in <br /> <br />good and efficient condition. <br /> <br />(b) The Contractor shall promptly make any and all repairs to the <br /> <br />Project works being operated by it which are necessary for proper care, opera- <br /> <br />tion, and maintenance. In case of neglect or failure of the Contractor to <br /> <br />initiate such repairs within 60 days following written notification, the <br /> <br />Contracting Officer may cause the repairs to be made, and the cost thereof <br /> <br />shall be paid by,the Contractor as prescribed by the Contracting Officer. <br /> <br />(c) No substantial change shall be made by the Contractor in any of <br /> <br />the major Project works without first obtaining written consent of the <br /> <br />Contracting Officer. <br /> <br />(d) The Contractor agrees to indemnify the United States ,for, and to <br /> <br />hold the United States and all of its representatives harmless from all suits, <br /> <br />actions, or claims of any cbaracter brought on account of any injury to any <br /> <br />person or property, resultir:>g from any act, omission, neglect, or misconduct <br /> <br />in the 'manner or method of executing any construction, care, operation, maince- <br /> <br />nance, supervision, inspections or other duties required under this contract <br /> <br />regardless of who.performs n::hose duties. <br /> <br />(e) In the event the Contractor is found to be operating the Project <br /> <br />works or any part thereof im violation of this contract, then at the election <br /> <br />of the Contracting Officer ~he United States may take over from the Contractor <br /> <br />the care, operation, and ma:intenance of such Project works by giving written <br /> <br />13 <br /> <br />Articles 10 and 11 <br />
