<br />~ <br /> <br />VI-3 <br /> <br />! <br /> <br />It was learned fran the water commissioner for District 38 that the <br /> <br /> <br />actual use by the State of the water out of Lucksinger Creek has been <br /> <br /> <br />slight in the past. The ditches were cleaned out in August of 1974 and <br />water was used in 1975 for irrigation. <br /> <br />The Commissioner was not certain of the accuracy of the records before <br /> <br />1975. since he was relying on information supplied by the State and <br /> <br /> <br />information supplied by the Town of Basalt in making his estimates of <br /> <br /> <br />actual use. He tends to think that less water was actually used than <br /> <br /> <br />is listed in the record. <br /> <br />. <br /> <br />The Commissioner also stated that he was unaware if the Town has a <br /> <br /> <br />measuring device on Lucksinger Springwhichmade it difficult to gage <br /> <br /> <br />the actual use of water from that source by the Town. According to <br /> <br /> <br />Mr. Glen Curtiss, there is a weir on the spring which shows that the <br /> <br />Town takes between 1.2 and 1.4 cfs from the spring. This weir was <br /> <br />installed in 1971. <br /> <br />. <br /> <br />The local state water administrators do not recognize Basalt as having <br /> <br /> <br />a decreed municipal water right from Lucksinger Springs and consider <br /> <br /> <br />Basalt's use as evidence of an unadjudicated municipal right that could <br /> <br />be called out by senior appropriators. <br /> <br />The Kelly Spring No.2 Ditch is owned by Frederick Arbaney and the <br /> <br /> <br />State Division of Wildlife. Mr. Arbaney was not certain of exactly <br /> <br /> <br />how much water he controls from this ditch. <br /> <br />. <br /> <br />. <br />
