<br />~ <br /> <br />, <br /> <br />SECTIOtl VI <br />WATER RIGHTS <br /> <br />. <br /> <br />GENERAL <br />A municipal water district is obligated to furnish water to its <br />customers every day of every year. In order to meet this obligation, <br />the water district must have the legal right to take water at the times <br /> <br /> <br />and in the amounts needed, and the water must be physically available <br /> <br /> <br />for diversion. It is vital that the Basalt water system continue to <br /> <br /> <br />be adequately safeguarded with water rights in sufficient quantity and <br /> <br /> <br />of sufficient seniority to cover its maximum diversion needs. A <br /> <br /> <br />growing community must have adequate water rights well in advance of <br /> <br /> <br />future needs if its growth is not to be checked by an insufficient <br /> <br /> <br />water supply. <br /> <br />. <br /> <br />BASALT WATER RIGHTS <br />The Town of Basalt owns the senior water right on Spring Creek, that of <br />the Basalt Spring, dating from March 15, 1883. This is the only water <br /> <br /> <br />right currently owned by the Town. This spring system is one of the <br /> <br /> <br />sources of the Town's municipal water supply. The decree is for 8.0 <br /> <br /> <br />cubic feet of water per second of time less 0.1 cfs for the Mallory decree <br /> <br /> <br />from May 1 to October 1 of each year. This right generally yields about <br /> <br /> <br />1.0 cfs from which the O. I cfs must be deducted. The right is quite <br /> <br /> <br />senior for the Roaring Fork Basin and would legally be firm in all years. <br /> <br /> <br />No consistent records have been kept on the yield of these springs. <br /> <br />. <br /> <br />. <br />
