Permits <br /> <br />The Corps of Engineers has determined that the new diversion structure is exempt from <br />regulation under Section 404 of the Clean Water Act and does not require a permit. A <br />copy of the letter from the Grand Junction Office of the Corps of Engineers describing <br />the exemption is included as Appendix E. Section 401 certification by the State of <br />Colorado is not required in the absence of a 404 Permit process. <br /> <br />7. Institutional Arrangements <br /> <br />A number of different entities are or may be involved in the design, construction, and <br />financing ofthe project. They include, in addition to the Smith Ditch Corporation: <br /> <br />Colorado River Water Conservation District (CRWCD); financing, <br /> <br />Colorado Water Conservation Board (CWCB); feasibility, financing, and <br />construction, <br /> <br />Farm Service Agency (FSA), Agricultural Conservation Program; financing, <br /> <br />Natural Resources Conservation Service(NRCS); design and construction, and <br /> <br />Upper Yampa Water Conservancy District (UYWCD); administration, feasibility, <br />financing, and construction. <br /> <br />The Upper Yampa Water Conservancy District will be the lead agency for the financing, <br />design, and construction of the project. The Smith Ditch Corporation will, however, <br />enter into contracts and agreements with the various entities for the services provided by <br />each. <br /> <br />The Smith Ditch Corporation is applying to the Colorado Water Conservation Board <br />(CWCB) for a Construction Fund loan for a portion of the costs of the project. The <br />Corporation will contract directly with the Board for repayment ofthe loan. <br /> <br />8. Financial Analysis <br /> <br />As indicated under Institutional Considerations above, a number of different entities will <br />be involved in financing the total project cost of$183,046.
