WHEREAS. required approval. c1ear:mce and coordination has beell accomplished from alld with appropriate
agencies: and

WHEREAS. the State and the Contactor entered into a
contract dated February 8. 1990. Contract Encumbrance Number
C-15357l (hereinafter the "Original Contract"): and

WHEREAS. Gubsequent to entering the UOriginal ContractU the
contractor ha6 opened bids for the rehabilitation of its
irrigation system by installing a new concrete syphon
nereinafter sometimes called the project; and

WHEREAS. the low bid submitted for the construction of the
project exceeded the amount estimated at the time the State
appropriated Eighty Thousand Dollars ($80.000) in funds for the
project: and

WHEREAS. paragraph 2 of section 1 of Senate Bill No. 15
(1987) authorizes the Colorado Water Conservation Board to
increase the Eighty Thousand Dollars ($80.000) loan for this
project if 'Iordinary fluctuations in conGtruction costs as
indicated by the engineering cost indices applicable to the
types of construction involved for such projects II is justified;
and

WHEREAS. the engineering cost indices have increased by
seven percent (7%) since Senate Bill No. 15 was approved.

NOW THEREFORE. it is hereby agreed as follows:

1. Consideration for this amendment to the Original
Contract. Conttact Encumbrance Number C-153571. Routing Number
90330. dated February 8. 1990. consists of the payments which
shall be made pursuant to this amendment and the promises and
agreements herein set forth.

2. This contract amendment is a supplement to the Original
Contract. Attachment A. which is by this reference incorporated
and made a part hereof: and all the terms, conditions. and
provisions thereof. unless specifically modified herein. are to
apply to this contract amendment as though they were expressly
rewritten. incorporated. and included herein.

3. Paragraphs A.13.. C.l.. and I. are hereby amended to
read as follows:

A.13. Repay to the State the total principal sum of
One Hundred Ninety-Nine Thousand Five Hundred Fifty Dollars
and Eighty Cents ($199,5&0.80). which includes the project
principal loan amount Of Eighty-Five Thousand six Hundred
Dollars ($8&.600.00) with interest at the rate of rive
percent (5%) per annum. said repayment to be made in
constant annual installments of Four Thousand Nine Hundred
EightY-Eight Dollars and Seventy-Seven Cents ($4,986.77)
each, for forty (40) years. as shown in Attachment B. attached
