<br />WHEREAS, pursuant to the provisions of section 37~60-119,
<br />Colorado Revised Stat~tes 1973, as amended, the State .is
<br />authorized to construQt certain water projects for. the benefit pf
<br />the people of the State of Colorado~ and
<br />
<br />WHEREAS, the San Miguel Water Conservancy District has .m?de
<br />application ~o the. State for a reconnaissance study of the
<br />rescoped San Miguel PI:'oject ~ and
<br />
<br />WHEREAS, the Contractor is a Water Conservancy District
<br />within the State of ~olorado~
<br />
<br />NOW THEREFORE, it is hereby agreed that
<br />
<br />1. The Contract0r shall have a reconnaissance study
<br />prepared and directed to rescope the San Miguel project in
<br />accordance .with a proDosal for a project report prepared by .the
<br />consulting engineerin9 firm of Weste~n Engineera, Inc., Grand
<br />. Junction, Colorado (the Consultant), and approved by the State,
<br />received April 23, 1984, which proposal -is attached hereto as.
<br />Exhibit A and made a part of this contract.
<br />
<br />2. Fifteen (lS) copies of the final study called for ,in
<br />this contract shall b~ furnished to the State not later than
<br />August 1, 1984, unles~ such time is extended by mutual agreement
<br />of the parties hereto in wr~ting.
<br />
<br />3. As compensatton for the servic~s of the C~ntractor, the
<br />State shall pay to th~ Contractor the sum of Fifty-Nine Thousand
<br />Dollars ($59,000) in the manner following:
<br />
<br />a. Sixty per~ent (60%), to wit, Thirty~Five Thousand
<br />Four Hundred Dollars' ($35,400) of the total amount due
<br />in two (2) m~nthly installments of Seventeen. Thousand
<br />Seven Hundreq Dollars ($17,700) each, commencing on
<br />June 15, 1981.
<br />
<br />b. The rematning forty percent (40%), to wit,
<br />.Twenty-Three Thousand Six Hundred Dollars ($2~,600)
<br />within forty. (40) days following receipt and acceptance
<br />of the writt~n report specified in paragraph 2 of this.
<br />contract. ' '.
<br />
<br />4. The total CO~t of services to be rendered for the
<br />Contractor by the Con~ultant is Sixty-Nine Thousand Dollars .
<br />($69,000) and the Contractor shal~ pay the .sum of ren Thousand
<br />Dollars ($10;000) as ~greed td by letter dated March 23, 1984;
<br />which is hereby attached and made a part of this contract as
<br />Exhibit B~ and in_no ~vent shall this payment be the liability of
<br />the State.
