<br />Under new Rules and Regulations adopted on the Arkansas River, all non-exempt irrigation and
<br />municipal wells must now fully augment their consumptive use. In order to use the Excelsior
<br />Ditch and its water right for augmentation, major rehabilitation work is required. The system
<br />must be capable of diverting its decreed water right, and capable of full operation to maintain
<br />that direct flow right. The ditch will have to be cleaned for its full length, a new river diversion
<br />works installed, two county road crossings installed, and two waste gates rebuilt along with
<br />numerous other improvements.

<br />The needed improvements will allow the project sponsor to either use the direct flow rights of
