Box 588 <br />Granby, Colorado 80446 <br /> <br />Subject: Winter Park Water & Sanitation District <br /> <br />Dear Stan: <br /> <br />The major principles of a cooperative agreement between the <br />District and the Denver Water BOard which would pernli t tbe <br />District to meet its minimum flow obligations at the Fraser <br />River gage are described below. <br /> <br />Any agreement I negotiated with you would include other <br />related matters and is subject to approval by my Board, <br /> <br />1. The exact wording of the minimum flow requirement <br />imposed upon the District by the Forest Service <br />must be made known to the Board prior to enter- <br />ing into an agreement. <br /> <br />2. The Board \4ill by--pass sufficient of the natural <br />flow of the Fraser River at the Board's Fraser <br />River head-gate to make up for net depletions <br />resulting from the District's operations above <br />the gage. <br /> <br />3. The District's diversions from the Fraser River <br />shall be made under the autl~rity of water rights <br />owned by the District. The Board's water rights <br />may not be used for this purpose. <br /> <br />4. Diversions by the District shall be by means of <br />its own facilities and not those of the Board. <br /> <br />5. In return for increasing its by--passes on the <br />Fraser River, the Board would decrease its by- <br />passes for downstream irrigation rights on <br />St. Louis Creek. This reduction would com~ <br />about by the retirement of the remaining <br />rights not owned by the Board in the Crooked <br />Creek Supply Ditch and the consequent retire- <br />ment of the ditch itself. <br /> <br />I <br />I <br />/ <br />, <br />I APPENDIX A <br /> <br />..', <br /> <br />" <br />
