WHEREns. pursuant to the provisions of section 37-60-119.
Colo(ado Revised Statutes. as ~mended, the State is authorized
to construct certain water projects for the benefit of the
people of the State oC Colorado; and

WHEHEns. the Contractor has made application to the State
for the improvement of its existing facility. such improvement
o[ the facility is hereinafter sometimes referred to as the
h)[oject; and

WHEREAS. the Contractor is a duly (armed Irrigation
District within the State of Colorado;

NOW THEREFORE. it is hereby agreed that:

1. The Contractor shall have a feasibility report prepared
and directed to the problem of improving its facilities in
accordance with a proposal (or a project feasibility report
prepared by the conSUlting engineering firm of W.W. Wheeler and
Associates. Inc. (the Consultant). and approved by the State.
received January 31. 1991. which proposal is attached hereto as
Appen~ix n and made a part of this contract.

2. vive (5) copies of the final report called [or in this
contract shall be furnished to the State not later than ninety
(90) days after the date o( this contract. unless such time is
extended by mutual agreement of the parties hereto in writing.

3. ns compensation for the services o( the Contractor. the
State shall pay to the Contractor the sum of Six Thousand six
Hundred Dollars ($6.600) in the manner following:

a. Sixty percent (60%). to wit. Three Thousand Nine Hundred
Sixty Dollars ($3.960) of the total amount due in two (2)
monthly installments of One Thousand Nine Hundred Eighty
Dollars ($1.980) each. commencing thirty (30) days after the
date of this contract.

b. The remaining forty percent (40%). to wit. Two Thousand
Six Hundred Forty D0113[S ($2.640) within forty (40) days
(ollowing receipt and acceptance of the written report
~pecified in paragraph 2. of this corttract.

q. The total cost of services to be rendered for the
Contractor by the Consultant is Thirteen Thousand Two Hundred
Dollars ($13.200) and the Contractor shall pay the sum of six
Thollsana six Hundred Dollars ($6.600) as agreed to by letter
