<br />EASEMENT DEED
<br />
<br />THIS EASEMENT DEED is made by and between LEONARD F.
<br />VALDEZ a/k/a LEONARD FELIX VALDEZ, whose legal address is P.
<br />O. Box 213, La Jara, Colorado, 81140, (heraina!tar referred
<br />to as 1I0wner"), and THE TERRACE IRRIGATION COMPANY, a
<br />Colorado Corporation, the legal address ot wh;i.cn. i~ 835
<br />First Avenue, Monte Vista, ColoradO, 81144 (ne~einafter
<br />referred to as the "Company"). ..

<br />WIT N E SSE T H
<br />
<br />WHEREAS, the Company is the owner and operator of a
<br />di tch system heretofore referred to as The Terrace Main
<br />Canal which diverts water from the A1amosa Creek at a point
<br />si tuate in the Southwest Quarter of Section Twenty-eight,
<br />Township Thirty-six North, Range Seven East, N.M.P.M. and
<br />which canal presently meanders in a west to east direction
<br />across the South Half of said Section Twenty-eight, Section
<br />Twenty-seven, the West Half of Section Twenty-six, and then
<br />turns in a south to northerly direction across the North
<br />Half of said Section Twenty-six, Section Twenty-three,
<br />Section Fourteen, Section Eleven, Section Twelve and Section
<br />One of 'l'ownship Thirty-six North, Range Seven East,
<br />N .M. P.M.; and Section Thirty-six of Township Thirty-seven
<br />North, Range Seven East, N.M.P.M.: and
<br />
<br />WHEREAS, the Company has resolved to construct a cement
<br />lined canal across a more direct route which more direct
<br />route must traverse across portions of the West One-half of
<br />Section Fourteen, Township Thirty-six North, Range Seven
<br />Eas t, N. M. P. M. which real property is owned by the Owner
<br />above set forth; and
<br />
<br />WHEREAS, at the expense of the Company, the centerline
<br />of the easement for said cement lined canal as it traverses
<br />the above described real property of Owner has been surveyed
<br />by Daniel M. Russell, a Colorado registered land surveyor,
<br />L.S.#225B3; and
<br />
<br />WHEREAS, the easement as surveyed is more particularly
<br />described as follows:
<br />
<br />An easement located in the West One-Half of Section
<br />Fourteen, Township Thirty-six North, Range Seven East,
<br />New Mexico Principal Meridian, Conejos County,
<br />Colorado, upon which a cement lined irrigation canal
<br />will be constructed and for the maintenance of said
<br />cement lined irrigation canal.
<br />
<br />The easement is 50 feet in width, being 25 feet on
<br />either side of the following described centerline, the
<br />sidelines of said easement being extended or shortened
<br />to' intersect the Sixteenth or Section Lines as
<br />appropriate:
<br />
<br />Beginning at a point on the South Line of Section
<br />Fourteen from which the Southwest Corner of said
<br />section (as monumented by a half inch rebar recovered
<br />this survey) bears S 89046'53" W a distance of 1086.01
<br />feet; thence N 24026'41" E a distance of 2051.57 feet;
<br />thence N 16"29'32" E a distance of 2398.95 feet; thence
<br />N 24011'10" E a distance of 86.11 feet: thence N
<br />37034'52" E a distance of 21.21 feet to a point on the
<br />east line of the West half of Section Fourteen and the
<br />end of this description (from which the North Quarter
<br />Corner of said Section as monumented by a 30 inch No. 6
<br />rebar with an attached 31 inch aluminum cap set by RLS
<br />#22583 bears N 00021'12" W a distance of 1038.96 feet).
