<br />. <br /> <br />. <br /> <br />C.R.S., 1988 & 1991 Supp. ("Part 14"), for negotiation of <br />consultation contracts; and <br /> <br />WHEREAS, the Contractor was selected as the most highly <br />qualified among no less than three persons ranked in order and <br />deemed to be most highly qualified to perform the required <br />professional services based on factors listed in section 24-30- <br />1403, C.R.S.; and <br /> <br />WHEREAS, the Contractor shall perform services involving the <br />practice of engineering as defined in Section 12-25-102 (10), <br />C.R.S.; and <br /> <br />NOW THEREFORE, it is agreed by the parties hereto as <br />follows: <br /> <br />A. The Scope of Services, Work Task Schedule, and Certificate <br />Concerning Compensation are defined in Exhibits A, B, and C, <br />respectively, which Exhibits are attached and incorporated <br />herein. <br /> <br />B. The Contractor agrees that it shall: <br /> <br />1. Conduct an analysis and prepare a final report in <br />accordance with the Scope of Services, Exhibit A. The Scope of <br />Services shall not be modified without written amendment to this <br />agreement. If the start date for this contract is delayed until <br />after September 1, 1993, then, by mutual agreement between the <br />state and the contractor, the number of field visits to dam <br />sites (as specified in Exhibit A, Task 2) may be reduced because <br />of weather related access problems. <br /> <br />2. Cause this project to be fully completed by February 14, <br />1994, and cause work to progress pursuant to the guidelines set <br />out in the Work Task Schedule, Exhibit B, except that the <br />completion date and schedule will be adjusted to allow 22 weeks <br />to complete the entire study if the start date is delayed beyond <br />September 1, 1993 as specified in Exhibit B. In its sole <br />discretion, the State may grant a written extension for the time <br />of completion of the study. <br /> <br />3. Provide the state with the number of copies of the Work <br />Products as stipulated in Exhibit A. A final draft of the study <br />report is due to the state on January 25, 1994. The final study <br />report will be due to the state on February 14, 1993. All <br />delivery dates specified herein are contingent on the state <br />issuing a Notice to Proceed with the study on or about <br />September 1, 1993 and will be adjusted accordingly if this <br />contract has not been executed by the state on or about that <br />date. <br /> <br />4. Commit to complete the study by February 14, 1994, or as <br />specified in paragraphs B.2. and B.3., and be liable for a <br /> <br />Page 2 of 1 Pages <br />
