Unit 77-77-777, ,WHEREAS. rel.juired approval. clearance and coordination has been accomplished from and with appropriate agencies; and . .... .WHEREAS. pursuant to the provisions of section 37-60-119. Col.oiado Revised Statutes, as amended, the State is authorized to construct certain water projects for the benefit of the people of the State of Colorado; and . WHEREAS. the San Luis Valley Water Conservancy District has made application to the State for the improvement of its existing facility. such improvement of the facility is hereinafter sometimes referred .to as the project; and WHEREAS, the Contractor is a water conservancy district within the State of Colorado; NOW THEREFORE, it is hereby agreed that: 1. The Contractor shall have a feasibility report prepared. and directed to the determination of the physical and legal availability of water in the Upper Rio Grande Basin. in accordance with a proposal for a project feasibility report prepared by the consulting enqineering firm of Leonard Ric$ Consulting Engineers. Inco (the Consultant). and approved by the State. dated November 12. 1986, which proposal is attached hereto as Exhibit A and made a part of this contract. 2._..Fif.teen.,US.) .copies of the final report called for in this contract shilH be furnished to the State not later than October 1. 1987. unless such time is extended by mutual aqr~ement of the parties hereto in writinq~~ 3. As compensation for the services of the Contractor. the State shall pay to the Contractor the sum of Seventy-Two Thousand Dollars ($72.000) in the manner following: a. Sixty percent (60\). to wit, Forty-Three Thousand Two Hundred Dollars ($43.200) of the total amount due in four (4) monthly installments of Ten Thousand Eiqht Hundred Dollars ($10.800) each. commencing on February 15. 1987. b. The remaining forty percent (40\). to wit, Twenty-Eight Thousand Eight Hundred Dollars ($28.800) within forty (40) days following receipt and acceptance of. the written report specified in paragraph 20 of this contract. 4.
