WHEREAS, Plaintiff/Contestors above named have commenced an election
contest in the above-entitled court aga~t the Defendants/Contestees above named;
and

WHEREAS, the statute setting forth the procedures governing election
contests, C.R.s, 9 1-11-213(3), requirell the Plaintiffs/Contestorll to file a bond
conditioned to pay all costs in case of failure to maintain the contest, and

WHEREAS, this contest concerns a ballot issue as defined in c.R.S. S 1-1-
104(2,3) and

WHEREAS, judgment against the Plaintiffs/Contestors for attorneys fees and
costs, may not be entered pursuant to c.R.S. S 1-11-217(2) unless the contest is found
frivolous, and

WHEREAS, the allegations in the State of Intention to Contest Election
establish good faith and reasonable grounds for challenging the election,

NOW THEREFORE, the Plaintiffs/Contestors have deposited with the Court
$200.00 cash, and do hereby promise that said amount will be paid to the
Defendants/Contestees for costs and fees they may sustain if the contest is denied
