<br />. WHEREAS, authority exis~s ~ th.e Law and Funds, have been budgeted, appropriated and 'otherwiSe 'made
<br />available 'and a sufficient unencumber~d balance thereof remains available for payment inFund Number 1001,

<br />WHEREAS, required approval; clearance and coordination ha~ been' accomplished from and with appropriate
<br />agencies; and
<br />
<br />. WHEREAS, "3 pursuant to the provisions of 149-1-22, Colorado Revised
<br />Statutes 1963, as amen~e~, the Colorada Water Conservation Board is
<br />autharized ta canst~ct certain water prajects far the benefit .of the
<br />, people .of the state of Calarada; and
<br />
<br />, WHEREAS, the Cedar Mesa Ditch CP. has made application to the Board
<br />far the canstruction .of a water project far the purpose .of supplying
<br />irrigatian water to the inhabitants, af,the, areas served by the
<br />applicant; and
<br />
<br />WHEREAS,
<br />the State of

<br />the Contract .or is a professianal engineering firm within
<br />Colarada, and has previously dane considerable water-
<br />for various municipalities ~nd' irrigation companies in .

<br />NOW J:HEREFORE, it is hereby agreed that
<br />
<br />I. ., The Contractor agrees ta prepare a feasibility repart ta
<br />study:
<br />
<br />headgates
<br />Creek and
<br />
<br />a. The construction of a "controll1 reservoir near the
<br />.of the Cedar Mesa Ditch Ca. ta stare the "bulge" in Surface
<br />deliver a steady flow of irrigatian water to Cedar Mesa.
<br />
<br />,the loss
<br />
<br />b., The rehabilitation of, the Cedar Mesa ditch to prevent
<br />of water due to seepage and transpiration.
<br />
<br />The above study is 'to be in accardance with a proposal dated
<br />November 27, 1974 for a praject feasibility repart prepared by the
<br />Contractor and approved by the Calorada Water Conservatian Baard. Said
<br />proposal is attached hereta as ,Exhibit A and,made part .of this contract.
<br />
<br />2. Thirty (30) capies .of the repart called far in this contract
<br />shall be furnished ta the State nat later than March 31, 1975, unless
<br />such time is ,extended by mutual agreement .of the parties hereto.
<br />
<br />, 3. As'campensation far the, services of the Cantractor, the
<br />State agrees to pay to the Cantractar the sum .of Three Thousand Seven
<br />Hundred'Fifty Dollars ($3,750.00) in the manner fallowing:
<br />
<br />a. Sixty percent (60%), to wit, Two Thousand Two Hundred
<br />Fifty Dallars ($2,250.00), of the tatal amaunt due intwa equal monthly
<br />,installments of One Thousand One Hundred Twenty-Five Dollars ($1,125.00)
<br />each, commencing an January 31, 1975.
