'J pursuant to the provIsions of 37-60-119, Colorddo <br />R~vlsed Statutes 1973, as amended, the Stdte is duthoriz~d to <br />construct certain water projects for the benefil of the people <br />of the State; and <br /> <br />WHEREAS, the Contractor is a duly constituted mutudl ditch <br />company in the State of Colorado dnd wIshes (0 undertdke <br />repairs of its irrigation system, hereInafter called the <br />project, for the Beaver Park Water, Inc., shdreholders in <br />Fremont County, Colorado, at dn estimated cost of Two Hundred <br />Seventy-Six Thousand Seven Hundred Fifty Dollars ($276,750); <br />.,Hld <br /> <br />WHEREAS, a feasibility investigation of sdid project WdS <br />conducted and it was found that such a project is economically <br />fedsIble; and <br /> <br />WHEREAS, the State has agreed to construct sdid project and <br />to sell the same to the Contractor upon mutually agreeable <br />terms dnd conditions, 5ubject to the availability of funding <br />for thdt purpose; dnd <br /> <br />WHEREAS, pursuant to Senate Blli No. 67, Fifty-Second <br />General Assembly of th~ State of Colorado, duly endcted Into <br />law, the Colorddo Wdter Conservdtion Board hdS been duthorized <br />to expend d sum not to exceed Six'Hundred Thirty Thousdnd <br />Dollar~ ($630,000) for construction of the project; <br /> <br />NOW THEREFORE, in consIderation of the mutudl and <br />dependent covendnts heI"eln contaIned, it Is dgreed by the <br />pdrties hereto as foll~ws; <br /> <br />A. The Contrdctor dgrees thdt it shdll: <br /> <br />1. Employ an engireerlng firm to prepdre project plans <br />dnd specifications for the proposed project. Both the <br />engineering fIrm and the project pldns dnd specificdtions shdll <br />be dpproved by the Stat~. <br /> <br />2. Subcontrdct the construction of said project to d <br />responsible and cdpable firm, saId project to be completed <br />wIthIn two (2) yedrs of the date of this contract in accorddnce <br />wIth the project plans- and soecifications and any necessdry <br />modirlcation thereof approved by the State. The State must <br />J.pprove, in wrItIng, all subcontracts before they become <br />ef1ective.
